After finishing law school, Smith started his career as an assistant district attorney in Manhattan. In 1999, he moved to the U.S. Attorney’s Office in the Eastern District of New York.
Between 2008 and 2010, he worked in The Hague, Netherlands, coordinating investigations for the International Criminal Court’s prosecutor’s office.
In 2010, he came back to the U.S. to lead the Justice Department’s Public Integrity Section. He stayed in that role for five years, handling many corruption cases.

On November 18, 2022, U.S. Attorney General Merrick Garland named him special counsel to lead the criminal investigations into Donald Trump’s role in the January 6 Capitol attack.
In December 2025, Jim Jordan, the head of the House Judiciary Committee, issued a subpoena requiring Smith to share documents and give testimony in a private session. Smith attended the deposition on December 17.
